GDPR-compliant registration of persons

To ensure that your JustRelate CRM system can also safely meet the requirements of the GDPR, we have in particu­lar adapted the contact management and implemented processes for processing requests from data subjects.

JustRelate CRM offers some helpful functions, which have been implemented in view of the data protection regulations and are described here in detail.

Attention

Attention: The regulations of the GDPR permit a broad spectrum of interpretation, which is why all data protection functions implemented in the CRM are to be seen as proposals only. The use in one’s own company is to be coordinated in each case with the Data Protection Officer.

Note on capturing competitors

Competitors are companies that offer a competing product or are active in the same target group.

If a contact is identified as a competitor, it is assigned to the Competitor group and automatically trans­ferred to Competitor Management.

§ GDPR: You must not record or categorise any persons as competitors, otherwise you would then have to observe GDPR data protection regulations. Obtain the consent of the person and comply with the duty to inform (Sections 13 or 14 of the GDPR)!

Pure company data of competitors is not covered by the GDPR. These can therefore be readily recorded.

The GDPR only comes into play when contact persons of competitors are to be recorded or when dealing with sole traders. Then Section 6 of the GDPR must be observed, and one would have to examine care­fully which basis of authorization could apply. As a rule, there shall be no consent from the competitor, nor will there be any contract. To justify processing on the basis of legitimate interests is also somewhat dubious. In addition, the duty to inform the contact persons or individual merchants must be observed (Section 14 of the  GDPR). Exemptions to the duty to provide information are also extremely weak.

Thus, recording company data of the competitor without contact persons or individual persons is legally secure.
